Acceptance of terms

By accessing or using TestBreak, you agree to be bound by these Terms of Service. If you are using the platform on behalf of an educational institution, you represent that you have the authority to bind that institution to these terms.

Service description

TestBreak is a web-based exam platform that enables educational institutions to create, deliver, and grade assessments. The platform includes exam creation tools, live proctoring, anonymous grading, and subject-specific toolboxes.

User roles and accounts

TestBreak supports staff roles including Teacher and Admin. Each role has specific permissions and access levels as described in our documentation.

  • Teachers can create exams, manage question banks, monitor sessions, and grade submissions
  • Admins can manage teachers, configure school settings, and access school-wide analytics

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify your administrator immediately of any unauthorized use.

Student access

Students access exams using an Exam Key and their name. Students do not create accounts. By entering an exam, students agree to the rules and proctoring conditions set by their teacher, including activity monitoring and focus tracking.

Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to circumvent security measures or proctoring controls
  • Share exam keys or content with unauthorized individuals
  • Upload malicious content or attempt to compromise the platform
  • Misrepresent your identity or role
  • Use automated tools to interact with the platform without authorization

Intellectual property

Exam content, questions, and materials created by users remain the intellectual property of the creating institution or individual. TestBreak does not claim ownership of user-created content.

The TestBreak platform, including its design, code, and documentation, is the intellectual property of TestBreak and is protected by applicable intellectual property laws.

Proctoring and monitoring

TestBreak includes proctoring features that monitor student activity during exams. These features may track browser focus, clipboard activity, network connectivity, and other signals as configured by the teacher.

Schools and teachers are responsible for informing students about the proctoring measures in use and obtaining any required consent. TestBreak provides the technical tools; compliance with local regulations is the responsibility of the institution.

Data and privacy

Your use of TestBreak is also governed by our Privacy Policy, which describes how we collect, use, and protect data.

Limitation of liability

TestBreak is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to data loss, service interruptions, or technical failures.

In no event shall our total liability exceed the amount paid by you for the service in the twelve months preceding the claim.

Modifications

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the revised terms. We will notify active users of material changes via email or in-platform notification.
